On 6 April 2020, the Government introduced new legislation to improve the welfare of pets by banning third-party sale of puppies and kittens in England known as Lucy’s Law.

Lucy’s Law made it illegal for commercial dealers to sell puppies and kittens unless they had bred the animals themselves.

Anyone wanting to get a new puppy or kitten in England must now buy direct from a breeder or consider adopting from a rescue centre instead.

Responsible breeders sell their kittens at 12 weeks or older. Many do not sell their kittens until they are between four and six months old. There are some who argue that a kitten is ready to be sold at age 10 weeks while most responsible breeders do not believe that this is best, its within acceptable ranges. However, any breeder who offers you a kitten younger than 10 weeks of age is not up on his or her research and doesnt have the kittens best interest in mind. A kitten younger than 10 weeks of age is not fully weaned or socialized. Most are not fully weaned or socialized until age 12 weeks or older. While some kitten buyers believe “the younger, the better” and that an older kitten will not bond, this simply isnt true. Cats are not pack animals and are able to bond with new humans at any time through their lives, even into old age.

Most kittens, left to their own devices, will become fully weaned between ten and twelve weeks of age. Most breeders begin introducing food sometime between four and five weeks of age, and the kittens gradually substitute mothers milk with solid food. However, weaning is a process, not an event kittens will continue to nurse and eat food together until they stop nursing on their own or Mom begins tiring of the activity and stops allowing them to nurse. The best solution for their emotional and physical health is to let the process take its course naturally.

Pet Sellers Generally Need A Sellers Permit

Generally, you must register with the California Department of Tax and Fee Administration for a seller’s permit if you are engaged in the business of selling dogs, cats, or other animals which are considered nonfood animals in California.

There are some exceptions:

  • If you sell no more than two pets or other nonfood animals during a twelve-month period, you are not required to hold a seller’s permit.
  • Cities, counties, or other local government animal shelters or nonprofit animal welfare organizationsthose that primarily prevent abuse, neglect, or exploitation of animalsare not required to collect sales tax for charges related to the adoptions of pets.

Why Is Lucy’s Law Important

The new law is part of the Government’s commitment to promoting better animal welfare.

Before Lucy’s Law was introduced, charities and animal rights groups had expressed concerns over the poor treatment of dogs in puppy farms, who were living in unsuitable conditions and separated from their mothers prematurely.

Members of the public who bought puppies and kittens from third-party commercial sellers were not always aware of the conditions their pets had been born and reared in. There were also reports of older cats and dogs that were sold after having accidental litters, with their owners unaware their pets were pregnant.

At the time, the RSPCA’s deputy chief executive Chris Wainwright said: “Breeders aren’t getting the scrutiny on their premises because they’re passing these dogs off to third parties and it often leaves families with sick animals.”

Between 2009 and 2019, the RSPCA dealt with almost 30,000 complaints relating to the illegal puppy trade. When investigating reports of animal cruelty and neglect, the RSPCA will offer advice and assistance where possible to improve animal welfare. This will include giving people time to make improvements to their standards of care.

In circumstances where this isn’t possible, where assistance hasn’t been accepted or where there have been deliberate acts of violence against an animal, the RSPCA will consider prosecution under laws such as the Animal Welfare Act.
